Welcome to TikMe ("we", "our", or "us"). These Terms of Service ("Terms") govern your use of the TikMe mobile application (the "App") and any related services provided by us. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

TikMe is a versatile mobile application that functions as a counter, metronome, and voice repeater. It is designed to help users with fitness workouts, practice training, memorization, and repetitive tasks by providing custom counting rules, auto voice broadcast, and data tracking features. The App is available on the Apple App Store and Google Play Store.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the capacity to enter into these Terms. If you are under the age of 18, you represent that a parent or guardian has consented to these Terms on your behalf.

3. User Accounts and Data

The App does not require you to create an account to use its core features. Your counting records, plans, and preferences are stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App. We are not liable for any loss of data resulting from device malfunction, deletion, or unauthorized access to your device.

4. Subscription and Payment

The App offers a free trial period of 7 days, after which a paid subscription is required to continue using premium features. The current subscription price is $1.00 USD per week. Subscriptions are managed through the Apple App Store or Google Play Store, and payment is processed by the respective platform at the time of purchase. Subscription terms, including renewal, cancellation, and refund policies, are governed by the terms and conditions of the platform through which you subscribed.

• Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period.
• Refunds: Refund requests are handled in accordance with the refund policies of the Apple App Store or Google Play Store. We do not process refunds directly.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable local, state, national, or international laws or regulations.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
• Use the App to transmit any harmful, offensive, or inappropriate content.
• Interfere with or disrupt the integrity or performance of the App.
• Share, transfer, or sell your subscription to any third party.

6. Intellectual Property

The App, including its design, features, content, graphics, and underlying code, is the intellectual property of TikMe and is protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works based on the App.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TikMe and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the App, whether in an action of contract, tort, or otherwise.

9. Indemnification

You agree to indemnify and hold harmless TikMe and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or your violation of these Terms.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, through an in-app notification. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
